Freedom of Information

The object of the Freedom of Information Act 1982 (the FOI Act) is to extend as far as possible the right of the community to access information held by Maroondah City Council.  

The general right of access is limited only by exemptions deemed necessary for the protection of essential public interest items together with the private and business affairs of individuals. 

Access

Individuals may apply for access to documents created and held by Council.  Documents are required to come within the ambit of the provisions of the FOI Act as there are a number of exemptions that apply to the availability of documentation. These exemptions include:

  • Documentation created prior to 1 January 1988 cannot be accessed by the Freedom Of Information process.  Individuals do however have the right to access their own personal information irrespective of its age
  • Personal affairs of another person
  • Documents affecting legal proceedings
  • Documents relating to a closed meeting of Council.

Access is also restricted to existing documents - those already created - as the FOI process is not designed to generate new documents.

Please note that if documents are required for a court hearing or litigation then a legal advisor should be consulted about processes other than FOI to gain access.

Requests for documents

An application fee of $28.40 is mandatory and must be attached with all requests/applications. 

All requests/applications must be in writing and be as specific as possible regarding the documentation being sought.  They should be addressed to:

Costs associated with access

FOI is a 'user pays' process.  Various charges apply depending on the costs incurred by Maroondah City Council in being able to locate and copy the requested documentation.  Applicants will be advised in writing of an estimate of any charges that may apply.

Overview of FOI process

Once the Freedom of Information Officer has received an application, a response period of up to 45 days applies.  Usually a reply is provided well within this period of time but it is dependent upon the complexity of the application and the availability of the requested information.

The Freedom of Information Officer will make a determination upon each application to grant full access, restrict access, or deny access.  Applicants may request a review of decisions made by the Freedom of Information Officer and reviews are conducted by the Freedom of Information Commissioner.

Changes are expected to apply to the FOI process from 1 September 2017.
